Donations of funds - Club & AGLC Approval Processes

Definitions of unrestricted and restricted funds

Restricted funds are those resulting from all activities related to gaming, i.e. bingos and casinos.
Unrestricted funds are those resulting from all other fund raising activities

Club approval process for restricted and unrestricted funds

For donations of more than $2,500 in aggregate to any one recipient in any one Rotary year from either restricted or unrestricted funds, club approval is required. This is a two step process to be undertaken as follows:

  1. Approval in principle is obtained from the RCCC Executive Committee
  2. A notice of motion to commit to the expenditure is made at three regular business meetings of the club with comments, questions and a vote at the third reading.

AGLC restrictions on donations

Restricted funds are defined as the proceeds of gaming, i.e. the proceeds of bingo and casino events.
The AGLC states their definition of charitable or religious objects of purpose in four basic ways:

  1. Relief of poverty,
  2. Advancement of education
  3. Advancement of religion, and
  4. Other purposes beneficial to the community

Any potential donations to be made that do not require formal written approval of AGLC requirements should pay particular attention to the following sections of the handbook

AGLC applications

All necessary correspondence and forms as noted below are to be completed and submitted to the AGLC by the chairperson of the applicable avenue of service and require the use of the Rotary Club of Calgary Centennial’s AGLC ID # - 66012.

For most forms, the signature of the club president and treasurer is required, and, in the case of one form, AGLC 5503, one of these two signatures must be witnessed by a commissioner for oaths.

Approved applications are normally returned to the club treasurer who will then ask for the appropriate cheque request to be submitted, i.e. either up to $2,500 or more than $2,500. Upon receipt of a completed cheque request the treasurer will then arrange for payment to be made either by cheque or by wire transfer, as appropriate.

In the event of a query being raised by AGLC the treasurer will contact the relevant avenue of service chairperson to provide any necessary information to AGLC

Donations within Alberta

Donations of up to $5000 per calendar year

Donations of up to $5,000 in aggregate from gaming proceeds to any one recipient in any one calendar year may be made to an eligible individual charity or religious group that actively delivers a program or service which provides a community benefit.
Donated gaming proceeds must be used for charitable or religious purposes.
The donor group (Centennial) must retain a written request from the recipient group stating the purpose for which the donation is to be used. If there is uncertainty as to whether or not the intended purpose qualifies as a charitable or religious activity contact AGLC Licensing Support, Regulatory Division at 708 447 8600..

Donations of more than $5000 per calendar year

Donations of more than $5,000 in aggregate from gaming proceeds in any one calendar year to any one recipient require the prior written approval of AGLC.
Donations may be made to an eligible individual charity or religious group within Alberta that actively delivers a program or service which provides a community benefit.
Donated gaming proceeds must be used for charitable or religious purposes.Complete and submit the following forms and documents to AGLC

AGLC form 5503 - Statutory Declaration for Donation

A written request to AGLC detailing the following:
  1. name and address of the recipient;
  2. the amount of the donation; and
  3. the purpose or purposes for which each donation will be used
  4. an agreement in writing signed by the recipient group staying the recipient group will:
  • maintain a record of donations showing the date, amount and source of donated funds received as well s the date, amount and purpose of all disbursements of donated funds, and
  • allow AGLC access to all records including those at any financial institution and to make copies of such records and/or remove them for further examination.

Donations outside of Alberta but within Canada

Donations of up to $5000 per calendar year.

Donations of up to $5,000 in aggregate from gaming proceeds in any one calendar year to any one recipient do not require the prior written approval of AGLC.

Donations may be made to an eligible individual charity or religious group that actively delivers a program or service which provides a community benefit.

Donated gaming proceeds must be used for charitable or religious purposes.

Donations are limited to a maximum cumulative total of 75% of gaming proceeds earned in the previous calendar year.

Donations of more than $5,000 per calendar year

Donations of more than $5,000 in aggregate from gaming proceeds to any one recipient in any one calendar year require the prior written approval of AGLC.

Donations may be made to an eligible individual charity or religious group that actively delivers a program or service which provides a community benefit.

Donated gaming proceeds must be used for charitable or religious purposes.
Donations are limited to a maximum cumulative total of 75% of gaming proceeds earned in the previous calendar year

Complete and submit the following forms to AGLC

AGLC from 5502 – Request to Donate Proceeds outside of Alberta but within Canada
AGLC form 5503 - Statutory Declaration for Donation
AGLC form 5507 -Gaming Proceeds – Recipient Agreement

Donations outside of Canada

Donations up to $1,000 per calendar year

Donation(s) of up to $1,000 in aggregate from gaming proceeds may be made to any one recipient in any one calendar year and does not require the prior written approval of AGLC.

Donations may be made to an eligible individual charity or religious group that actively delivers a program or service which provides a community benefit.

Donated gaming proceeds must be used for charitable or religious purposes.

Donations are limited to a maximum cumulative total of 50% of gaming proceeds earned in the previous calendar year

Donations of more than $1000 per calendar year

Donation(s) of more than $1,000 in aggregate from gaming proceeds to anyone recipient in any one calendar year requires the prior written approval of AGLC.

Donations may be made to an eligible individual charity or religious group that actively delivers a program or service which provides a community benefit.

Donated gaming proceeds must be used for charitable or religious purposes.

Donations are limited to a maximum cumulative total of 50% of gaming proceeds earned in the previous calendar year

Complete and submit the following forms to AGLC

AGLC form 5503 - Statutory Declaration for Donation
AGLC form 5507 -Gaming Proceeds - Recipient Agreement
AGLC form 5484 - Request to Donate Proceeds outside of CanadaTravel reimbursement

Travel outside of Alberta but within Canada requires the prior written approval of the AGLC. For travel outside of Canada the application must demonstrate that a similar activity does not exist in Canada
A letter of invitation/approval/ sanction list together with a detailed daily schedule and the names and positions held of all those attending must be attached to the application

Notes on completion of relevant AGLC forms

  1. AGLC form 5502 - Request to Donate Proceeds Outside of Alberta but within Canada
    This form must be executed by both the president and treasurer of the RC of Calgary Centennial.
  2. AGLC form 5503 - Statutory Declaration for Donation
    This form must be executed by both the president and treasurer of the RC of Calgary Centennial and of one of these two signatures must be witnessed by a Commissioner for Oaths.
  3. AGLC form 5506 - Request to Amend Use of Gaming Proceeds
    This form must be executed by both the president and treasurer of the RC of Calgary Centennial.
  4. AGLC form 5507 - Gaming Proceeds - Recipient Agreement
    This form contains some information about Centennial but must also be executed by a responsible executive of the recipient organisation.
  5. AGLC form 5443 - Travel Itinerary
    This form must be executed by both the president and treasurer of the RC of Calgary Centennial.
  6. AGLC form 5484 - Request to Donate Proceeds outside of Canada
    This form must be executed by both the president and treasurer of the RC of Calgary
    Centennial.
